How many people are aware that the HSE has dedicated pages on its website covering their Governments approach to the legal framework around health and safety? Whilst they welcome and adhere to overall UK Governments on legislation, Scotland has introduced its own 'concordat' between the HSE and the Scottish Parliament. The website aims to ensure health and safety in Sctoland is covered thoroughly where its legal framework differs from that of the UK. An example of this refers to the fact that in Scotland their exists the Procurator Fiscal. The HSE Scotland website introduction states that, " The aim of this site is to provide information on the work of the Health and Safety Executive and its partners in delivering higher standards of workplace health and safety in Scotland." The 'concordat' between the HSE and the Scottish Parliament mentioned earlier, makes interesting reading, with the inyroduction to the document stating: "The Scottish Executive has always considered that although workplace health and safety legislation is reserved to Westminster we have an important role in promoting good health and safety practice in Scotland." It goes on to say: " This is relevant both in helping to challenge those
who fail to meet necessary standards - through the administration of justice in relation to
health and safety offences and penalties - and in promoting the benefits of good health and
safety management to Scottish businesses and Scotland's economy, for example, in the
context of Smart, Successful Scotland. The concordat covers such areas as prosecution and penalties, gas safety, fire safety legislation: Promotion and Publicity, better business regulation and how it applies and affects health and safety in Scotland, occupational safety and workplace wellbeing and the The Partnership on Health and Safety in Scotland (PHASS) which was established in 2005 by the HSC.
